Who is eligible for Supplemental Security Income (SSI)?
Both adults and children can qualify for SSI. SSI benefits are paid to disabled adults and children and are based on need. Only people with limited assets will qualify. For an adult, the disability requirements are the same as for Social Security Disability Insurance benefits. However, it is not necessary to have an earnings record to receive SSI benefits. The level of income provided to a successful SSI claimant is minimal, but is usually desperately needed. Also, an SSI recipient will often qualify for State Medicaid benefits and food stamps. A child can also qualify for SSI benefits if he or she meets Social Security's requirements for those benefits by proving a disability recognized by Social Security, and the household income for the child is below certain limits set by Social Security. In determining whether a child is disabled, Social Security is concerned with the ability of the child to function as compared with other children of the same age.
What if my claim was denied?
If your claim was denied, you are not alone. In Ohio, three out of every four disability applications are denied. At the first appeal level (Reconsideration), only one out of every 10 claims is allowed. If you are denied at the Reconsideration level, you must request a hearing and face waiting up to three years for an Administrative Law Judge to hear your case. You can contact an attorney as soon as possible to handle your claim and mitigate the frustrations of the process.
SSI for children
I have extensive experience in successfully representing children in obtaining SSI benefits. If you are interested in seeking SSI benefits on behalf of your child, it is important to consult with an attorney about your case. As your lawyer, I will gather all relevant records, including school records, teachers' questionnaires, and medical reports, and will file necessary documentation to provide the best chance for a successful result in your child's case.
Successfully handling your SSI claim
At your initial consultation for your SSI claim, we will discuss your situation and the facts of your case so that I can provide you with realistic expectations. We will discuss your background and your disability (or your child's disability) to get the information I need to proceed in your case. If your case does require a hearing, I will make sure that your file is updated and contains all of the relevant evidence needed to support your claim. I will help you prepare for your testimony and will provide my extensive litigation experience that has earned me the respect of judges, my peers, and most importantly, my clients.
